These Terms and Conditions (“Terms”) govern your access to and use of ChartPilot (the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Who we are

ChartPilot is a software service that provides market screening and analytics tools. For questions about these Terms, contact us at support@chartpilot.app.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into these Terms. You are responsible for complying with all applicable laws, rules, and regulations in your jurisdiction.

3. Nature of the Service (No Financial Advice)

The Service provides market data, analytics, and informational signals for educational purposes only. ChartPilot is not a broker, investment adviser, or financial planner. Nothing in the Service constitutes financial, investment, tax, legal, or any other professional advice, nor a solicitation to buy or sell securities or crypto assets. You are solely responsible for your decisions. Trading involves substantial risk of loss.

4. Accounts & Subscriptions

• You may need an account to access certain features. Keep your credentials confidential and do not share them.
• Subscription plans, features, and pricing are described at checkout and/or in your account. We may update plans and pricing from time to time (changes apply on renewal unless otherwise stated).
• We may suspend or terminate access if we detect misuse, abuse, fraud, or non-payment (see Section 11).

5. Billing, Trials & Refunds

• Paid plans renew automatically unless you cancel before the renewal date. Taxes may apply.
• If a trial is offered, you will be charged when it ends unless you cancel in time.
• Our default refund window is 7 days from initial purchase, provided there is no unreasonable or abusive usage (e.g., automated scraping/export in volume). To request a refund, contact support@chartpilot.app. Local consumer rights may apply.

6. Acceptable Use

• No reverse engineering, scraping at scale, or bypassing rate limits.
• No sharing, reselling, or sublicensing of accounts or data.
• No unlawful, infringing, or harmful activity.

7. Intellectual Property

The Service, including software, UI, logos, and content, is owned by ChartPilot or its licensors and is protected by IP laws. You receive a limited, non-exclusive, non-transferable license to use the Service as permitted by these Terms.

8. Data & Privacy

We process personal data as described in our Privacy Policy. By using the Service, you consent to that processing.

9. Third-Party Services & Data

The Service may rely on third-party providers (market data, payments, auth, etc.). Availability, accuracy, and latency of third-party data are not guaranteed. Third-party terms may apply.

10. Availability & Changes

We strive for continuity but do not guarantee uninterrupted, timely, or error-free Service. We may modify, suspend, or discontinue features at any time. Material changes to these Terms will be posted here and take effect upon posting or as otherwise indicated.

11. Termination

You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms, suspected fraud/abuse, unlawful activity, or non-payment. Upon termination, your right to use the Service ends.

12. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. MARKET DATA AND SIGNALS MAY BE DELAYED, INACCURATE, OR INCOMPLETE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHARTPILOT AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU FOR THE SERVICE IN THE 3 MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.

14. Governing Law

These Terms are governed by applicable law of your place of residence or, if specified by us, another jurisdiction. Courts with competent jurisdiction will have exclusive venue, unless mandatory consumer law states otherwise.
